Subpart C—Characteristics of Hazardous Waste § 261.20 General. (a) A solid waste, as defined in § 261.2, which is not excluded from regulation as a hazardous waste under § 261.4 (b), is a hazardous waste if it exhibits any of the characteristics identified in this subpart. Wastes (except wastewater and spent carbon from hydrogen chloride purification) from the production or manufacturing use (as a reactant, chemical intermediate, or component in a formulating process) of tri- or tetrachlorophenol or of intermediates used to produce their pesticide derivatives. Toxicity Characteristics (D Codes) A waste can, and often does, carry multiple codes. For example, spent trichloroethylene might be listed as F001 (spent halogenated degreasing solvent) and also exhibit D040 (TCE toxicity characteristic). A waste is determined to be a hazardous waste if it is specifically listed on one of four lists (the F, K, P and U lists) found in title 40 of the Code of Federal Regulations in part 261.
